Cakeday lets a person (the "recipient") receive monetary gifts ("shouts") from friends and family, themed as menu items like drinks and meals. The themed item is a gift suggestion, not a purchase of goods: the recipient receives the money value of the item and may spend it however they like. Cakeday is not a bar, restaurant, or seller of food or alcohol, and no alcohol is sold, supplied, or delivered through the service.
The person shouting pays the menu price plus a flat shout fee ($3 for most items, $5 for items of $100 or more), shown clearly before payment. The recipient receives 100% of the menu price. Optional instant payouts carry Stripe's instant-payout fee (about 1%, minimum $0.50), shown before you confirm. There are no other charges.
All payments are processed by Stripe. To receive money, the recipient must complete Stripe's identity verification and connect an Australian bank account or debit card — only the recipient can do this, and Cakeday never holds your money: funds settle through Stripe directly to the recipient. Standard payouts arrive in around 2 business days (first payouts for new accounts can take longer under Stripe's rules); instant payouts arrive in minutes. If a page is set up for someone else, shouts are held by Stripe until the recipient claims the page and completes verification; if a page is never claimed within Stripe's required window, payments will be refunded to the senders.
You must be 18+ to create a Cakeday page or receive payouts. Shouts themed as alcohol are money gifts and do not constitute the supply of alcohol; regardless, we ask everyone to celebrate responsibly. Messages and photos posted to a Cakeday wall must be things you'd be happy for the birthday person's grandmother to read. We filter abusive language, anyone can report a message (it's hidden immediately pending review), and we may remove content or close pages that are abusive, fraudulent, unlawful, or that impersonate someone else. Only set up a page for another person with their knowledge or as a genuine surprise gift for someone who would welcome it.
Shouts are gifts and are generally not refundable once the recipient has been paid out. If a page is never claimed, Stripe refunds senders automatically. If something's gone wrong — duplicate charge, mistake, fraud — email us and we'll sort it out quickly. Nothing in these terms limits your rights under Australian Consumer Law.
Cakeday is provided "as is"; to the extent the law allows, we're not liable for indirect or consequential loss. We may update these terms; material changes will be posted here with a new date. These terms are governed by the laws of Australia.
